What Is Wrongful Death?

When a person is killed because someone else acted negligently or carelessly, the law considers it a wrongful death. Because it is difficult to prove that another person’s conduct caused a death, bringing a successful wrongful death case is a complex legal process that requires a thorough knowledge of the law.

Connecticut law requires the presence of four elements to prove a wrongful death claim. You must be able to show the following:

  • The death was caused either in part or wholly by another person or entity, such as a company
  • The person who caused the accident acted negligently or carelessly
  • The deceased’s surviving family members have been impacted by the loss
  • The survivors have been financially damaged because of the death

Before survivors can bring a wrongful death lawsuit, they must first choose a personal representative to act on behalf of the deceased’s estate. If the decedent had a will, this individual is called an executor. If the person died without a will, the personal representative is known as an administrator.
