Attorney Jim Nugent Successful in negligent Emotional Distress Claim


On Monday, June 23, 2014, Attorney Jim Nugent obtained another victory on behalf of Connecticut insureds. Nugent & Bryant’s client, Andrew Riley, a resident of Pomfret, Connecticut, suffered fire damage to his home in 2009.


His devastation quickly turned to a nightmare when his insurance company, Travelers Insurance, denied his homeowner’s insurance claim, accusing him of arson. Travelers claimed its internal investigation revealed that Mr. Riley set his own home on fire, then used this investigation as a basis to deny his claim and wrongfully accuse him of intentionally setting his house ablaze. Jim Nugent highlighted Travelers’ labeling of Mr. Riley as an arsonist as the focal point of the damage aspect of the case. West Hartford attorney, Leonard M. Isaac, brought suit against Travelers in 2011. Attorney Isaac asked Jim to associate with him to try the case.


A Hartford, Connecticut jury agreed with Mr. Riley, awarding him $504,346.10 for the fire damage to his home and $1 million for the severe emotional distress he suffered from being labeled an arsonist by his own insurance company.
