Sometimes both are in play. The rideshare company will try to push liability onto the driver’s personal insurer, and the personal insurer will try to push it back. You need someone who has been through this before.

Connecticut Legal Requirements for Rideshare Accident Cases

Rideshare cases in Hartford are governed by a combination of Connecticut statutes and the insurance structures that Uber and Lyft are required to maintain.

The Connecticut Transportation Network Company Act sets the rules. When a driver has the app turned on but has not accepted a ride, the rideshare company must carry at least $50,000 per person and $100,000 per accident in liability coverage. Once the driver accepts a ride or has a passenger in the car, coverage jumps to $1 million in combined single-limit liability. That jump from $100,000 to $1 million is enormous, and figuring out which tier applies at the moment of the crash is usually the first fight in a rideshare case.

The two-year statute of limitations under CGS § 52-584 applies to rideshare accident injury claims, just like any other motor vehicle crash. If you do not file within two years of the accident, you lose the right to sue entirely.

Connecticut’s modified comparative negligence rule under CGS § 52-572h is also in play. You can recover damages if your fault is 50% or less, reduced by your percentage of responsibility. Insurance companies use this rule to argue that you contributed to the crash and should receive less money, and we know how to fight back against comparative fault arguments.

One additional complication is that Uber and Lyft classify their drivers as independent contractors, not employees. This affects the legal analysis of liability, but it does not eliminate the company’s obligation to maintain insurance under Connecticut law. What the classification does affect is whether you can pursue a claim directly against the rideshare company for the driver’s negligence, or whether you are limited to claims under the company’s insurance policy. Either way, there is a policy, and the question is which one applies and how much it covers. Getting that determination right often means the difference between a $50,000 policy and a $1 million policy.

What Damages Are Recoverable in Hartford Rideshare Accident Cases?
